Terms of the online store

General provisions

1. These regulations define the rules for purchasing goods in the online store www.jasiolka.pl - referred to below as the online store or store, kept at the internet address www.jasiolka.pl and the rules for the delivery of purchased goods to the customer.

2. Placing an order on the website www.jasiolka.pl is tantamount to acceptance of the rules resulting from these Regulations and obliges the customer to comply with these rules.

Activity The online store www.jasiolka.pl sells goods via the Internet. Orders are accepted by the website www.jasiolka.pl.

The area of ​​operation of the Online Store www.jasiolka.pl enables the transport of selected items of the assortment within the Voivodeship / District ... ............. and the surrounding area through company cars.

Commercial Offer The order placed by the Customer constitutes an Offer within the meaning of civil law. Sending an e-mail message by the Online Shop confirming the scope of the order is the acceptance of the Offer in the scope possible to be realized.The presence of products on the Store's website is not synonymous with the availability of the goods in the warehouse and the possibility of fulfilling the order.

Price

The prices of goods and delivery costs shown on the website www.jasiolka.pl are gross VAT prices, expressed in Polish zlotys.

The sales contract and the valid price The sales document is always compliant with the sales price valid at the time of acceptance of the order, regardless of the selected delivery date.

Delivery and price of delivery Products offered on the Online Store website are delivered via company cars. The cost of delivery in the area ... ............. is not dependent on the amount of the order and amounts to ... ..... PLN gross.

The payment for all deliveries takes place at the receipt of the goods, unless otherwise agreed.

CUSTOMERS ORDER

Submission and acceptance of the order.

The order consists of choosing from the assortment presented on the website of the Online Store. After adding products to the shopping cart, the order is accepted after clicking the "Checkout" button and then "Finish". It is possible to execute the order only after prior registration of the client at www.jasiolka.pl. Registration requires providing personal data, address, telephone number and e-mail address.

Confirmation and execution of the order The acceptance of the Customer's order is confirmed electronically by sending an e-mail to the Customer. If the order can not be processed within the required deadline or in the case of shortages in the assortment, the Customer will be notified by e-mail or by phone.

Days off

The online store www.jasiolka.pl does not carry out orders on Sundays and public holidays. The online store reserves the right to set additional days to close the store. These days it will not be technically possible to reserve a delivery date.

Refusal to execute orders

The online store reserves the right to refuse to execute orders in the following cases:

a) There are clear difficulties in determining the identity of the person placing the order

b) The order could not be confirmed and it was considered by the Store as requiring confirmation in the event of a need to change the delivery date or composition of the ordered goods

c) The client does not follow the rules of these Terms;

PAYMENT

Payment methods.

The following methods of payment are possible: only cash on delivery, or other agreed individually, e.g. with deferred payment.

Settlement of underpayments or overpayments

The online store offers variable weight products for sale (not prepacked, freshly prepared before delivery). The weights of these products indicated by the Customer are approximate weights, and employees of the Online Store will make every effort to ensure that the final weights of ordered items are as close as possible to the approximate ones. If the final weight of the parcel will differ by more than 15% from the order, the customer has the right to withdraw from the contract. The final price of a variable weight product is determined based on its actual weight. Both the weight of the product and its final price are shown on the VAT invoice or receipt. When ordering a product with a variable weight, the customer accepts its final price.

Invoice

a) A VAT invoice or a receipt confirming the purchase is attached to the order, including the delivered order items. The customer authorizes the Online Store to issue VAT invoices without the recipient's signature.

b) In order to receive a VAT invoice, the Customer is obliged to provide the company's name and tax identification number in the registration form.

The right to withdraw from the contract

a) The customer has the right to withdraw from this contract within 14 days without giving any reason.

b) The deadline to withdraw from the contract expires after 14 days from the date on which the customer came into possession of the item or in which the third party indicated by the customer came into possession of the item.

c) In order to exercise the right of withdrawal from the contract, the Customer should inform the Online Store of their decision to withdraw from this contract by an explicit declaration by e-mail stating their first and last name, full address and, if available, telephone number and e-mail address.

d) To keep the deadline to withdraw from the contract, it is enough to send information regarding the exercise of the right to withdraw from the contract before the deadline to withdraw from the contract.

e) In the event of withdrawal from the contract, the customer is obliged to hand over the returned goods in an unaltered state. The goods should be returned directly to the address of the Seller, but no later than within 14 days from the date on which the Seller received the notification of withdrawal from the contract.

f) In the event of withdrawal from the contract, all payments received, including delivery costs (except for additional costs resulting from the selected method of delivery other than the cheapest method of delivery offered by us), shall be returned to the Customer immediately, and in any case not later than 14 days from the day on which we were informed about the decision to exercise the right to withdraw from this contract. We will refund the payment using the same payment methods as were used in the original transaction, unless the Customer expressly agreed otherwise; in any case, the Customer shall not pay any fees in connection with this return.

g) The right to withdraw from the contract by the consumer is excluded in the case of:

a contract in which the subject of the provision is a non-prefabricated item, produced according to the consumer's special request or serving to satisfy his individual needs;

a contract in which the object of the service is an item which is subject to rapid deterioration or has a short shelf-life;

a contract in which the object of the service is an item delivered in a sealed package, which after opening the packaging can not be returned due to health protection or hygiene reasons, if the packaging was opened after delivery.

COMPLAINTS AND RETURNS

In the event of non-compliance of the food product with the contract, the buyer has the right to demand the replacement of the product, or a price reduction or withdrawal provided they notify the seller immediately after finding the non-conformity of the goods with the contract, no later than 3 days after delivery of the order. In order to make a complaint, please contact the Online Store by e-mail or by phone.

A complaint will be processed within a maximum of 7 days. The client will be notified in writing of the result of its consideration to the e-mail address or the address of residence. No response within the specified time will be considered as a positive consideration of the complaint.

The store returns the amount due to the customer for the returned goods within 7 days, counting from the day of the positive consideration of the complaint, to the account indicated by the customer by email.

The online store does not accept any parcels paid on delivery.

Differences between the actual appearance of the product and its photo on the website of the Online Store can not be the basis for a complaint and return of the purchased goods.

DELIVERY

The supplier leaves the order to the person located at the address indicated by the customer. The supplier is not able to verify the personal data of the recipient of the goods.

Customer absence

In the absence of the Customer at the address indicated by them while ordering delivery on the day indicated in accordance with the delivery schedule, an employee of the Online Store will attempt to contact the customer by phone. If a new delivery date is set, the order will be delivered again at the new set time.In this case, the customer will be charged a double transport fee. The online store is not responsible for the quality of products that, for reasons attributable to the customer, will become impossible for later use (perishable products, fresh products, short expiry dates, etc.). The customer can not refuse to accept them for this reason, without paying the sale price.

Refusal to accept the order

Unjustified refusal to accept the order by the customer is treated as a violation of the rules of these Terms of service. 

FINAL PROVISIONS

The customer using the Online Store services is prohibited from providing illegal or false content. Orders containing such content will not be implemented. The online store is not responsible for providing such content.

Delivery of e-mails

The online store is not liable for non-delivery of messages sent to the e-mail address indicated by the Customer, which is caused by blocking or deleting emails by software installed on the computer used by the Customer or blocking by the administrators of e-mail servers.

If the order can not be processed in accordance with the provisions of these Regulations, the Store will refund the amount due to the account specified by the Customer.

Personal data - GDPR

According to art. 13 para. 1 and 2 of Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of individuals with regard to the processing of personal data and on the free movement of such data and repealing Directive 95/46 / EC (general regulation on data protection) (Official Journal of the EU from 2016, No. 119, page 1) - hereinafter the GDPR, I inform that:

a) By registering at www.jasiolka.pl and making purchases via the website, the customer consents to the processing by "JK" Sp. z oo with its registered office in Lublin, ul.I Armii Wojska Polskiego 5 / 6E, 20-075 Lublin, KRS: 000269992; NIP number: 9462507867, of their personal data to the extent necessary to execute orders and communicate with the client.

d) Your personal data are processed on the basis of art. 6 par. 1 lit. f of GDPR, i.e. based on the necessity of processing for purposes resulting from legally justified interests performed by the Administrator or by a third party, based on the Customer's consent.

e) Legally legitimate interests pursued by the Company consist in offering products from the cold meat production industry to clients. The company also provides data facilitating the implementation of marketing campaigns.

f) Your personal data are processed manually and automatically to provide customers with products sold by the Company, as well as for statistical purposes.

g) In relation to the processing of your personal data, you have the right to:

- request the Administrator to give you access to your personal data,

- request the Administrator to correct your personal data,

- request the Administrator to delete your personal data,

- request the Administrator to limit the processing of your personal data,

- object to the processing of your personal data,

- transfer your personal data,

h) Personal data will not be transferred to a third country / international organization outside the area of the GDPR.

i) You have the right to lodge a complaint with the supervisory body, which is the President of the Office for Personal Data Protection (www.uodo.gov.pl), if your data is processed contrary to legal requirements.

j) Providing personal data requires consent and the consequence of disagreement or non-authorization results in: the inability to provide your services by the Online Store.

We also inform you that

Administrator makes every effort to provide all means of physical, technical and organizational protection of personal data against their accidental or deliberate destruction, accidental loss, change, unauthorized disclosure, use or access, in accordance with all applicable laws.
